Payment for the services provided may be made by transfer or via the imoje.ing.pl payment gateway of ING Bank Śląski SA with its registered office in Katowice.

Complaint procedure

Withdrawal from the contract

The Service Recipient has the right to withdraw from the contract in accordance with the terms specified therein, taking into account the provisions of generally applicable law.

The rights referred to above also apply to a natural person concluding a contract directly related to his or her business activity, when the content of this contract indicates that it is not of a professional nature for that person, resulting in particular from the subject of the business activity performed by him or her, made available under the provisions on the Central Register and Information on Business Activity.

In the event of withdrawal from the contract after the provision of services has commenced, the Service Recipient is obliged to cover the costs of the activities performed so far.

Job candidate - your data is processedą:

  • in order to carry out the recruitment process, pursuant to Art. 6 section 1 letter c GDPR, i.e. our legal obligation to collect data of job candidates to the extent specified in Art. 221 of the Labor Code - which refers to the following personal data: name, surname, date of birth, contact details provided by you, education, professional qualifications and previous employment history. Any personal data beyond the scope indicated in Art. 221 of the Labor Code are processed pursuant to Art. 6 section 1 letter a GDPR, i.e. your consent. If you consent to further processing of data contained in recruitment documents for the purposes of subsequent recruitment, the data will be processed on the basis of consent to the processing of personal data for the purposes of further recruitment (Article 6(1)(a) of the GDPR). Data is also processed pursuant to Art. 6 section 1 letter f GDPR, i.e. on the basis of the legitimate interest pursued by the administrator, which is to determine, pursue possible claims or defend against such claims.

  • for the purpose of employment, execution of an employment contract and keeping personal files and provision of employment-related benefits (including ZUS and tax obligations).
  • the basis for the processing of your personal data to the extent specified in Art. 221 1 and 3 of the Labor Code, i.e. your name and surname, date of birth, contact details and residential address provided by you, your education, professional qualifications and previous employment history, as well as your PESEL number (and in case of its absence, the type and number of the document confirming your identity ), the payment account number to which we pay your remuneration and other personal data, the provision of which is a condition for exercising the rights related to employment and fulfilling the administrator's obligations related to your employment, is Art. 6 section 1 letter c GDPR, i.e. the necessity of personal data to fulfill the legal obligation imposed on the administrator, and the basis for the processing of your special category personal data, such as health-related data, is Art. 9 section 2 letter b and h of the GDPR - the processing of special data (related to health) is necessary to fulfill the obligations and exercise specific rights by the controller or the data subject in the field of labor law, occupational medicine, social security and social protection.
  • another legal basis for the processing of your data in employment is Art. 6 section 1 letter f of the GDPR - processing is necessary for the purposes of the legitimate interests pursued by the administrator. The legally justified interest of the administrator as an Employer is to ensure safety in the workplace, including information security, data processing for internal administrative purposes, identification and efficient communication, maintaining business contacts and performance of contracts concluded with the administrator's clients, as well as determining and pursuing possible claims. or to defend against such claims (in this respect also Article 9(2)(f) of the GDPR).

How we obtain your data

In most cases, data is obtained directly from you. However, they may also be provided to us indirectly - e.g. by your employer, co-worker, partner indicating you as a contact person.

If we obtain data of contact persons or representatives of clients or contractors, we process data such as name, surname, e-mail and business telephone number, position held, and data contained in public registers (KRS, CEIDG).

Data recipients 

The recipients of your personal data may be entities cooperating with us and providing services to us, such as courier companies, translation agencies, notary offices, law firms, banks, providers of e-mail, cloud solutions, web applications, and external entities providing IT services. Access to personal data may be obtained by authorities or entities authorized under separate regulations (including ZUS, tax office, courts, bailiffs, regulatory and supervisory authorities)

In addition, the data is transferred to the entity providing accounting, HR and payroll, recruitment services, and providing and operating the server space where the data is stored.

In addition, employee data may also be transferred to clients or contractors in connection with the implementation of contracts, as well as to entities cooperating in the field of occupational health and safety, insurance protection, medical care or additional benefits.

The data of contractors (freelancers) and persons cooperating with us on the basis of a civil law contract may also be transferred to clients or other contractors in connection with the implementation of contracts, as well as to entities cooperating in the provision of additional services.

Transferring data to pańthird parties

As a rule, we do not transfer data to third countries and international organizations. However, we use email provided by Microsoft. Personal data will be stored on servers located in the European Union, but may be transferred to a third country. Microsoft participates in the Data Privacy Framework, and on July 10, 2023, the European Commission issued an implementing decision pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council, stating the adequate level of protection of personal data provided under the EU-US data protection framework.

Data storage period

If the purpose of processing personal data is:

  • Recruitment - data will be stored for the duration of recruitment and will be deleted within 6 months from the end of recruitment. In the case of data obtained on the basis of consent, the data will be processed until the consent is withdrawn, but no later than 6 months from the end of recruitment. If you consent to the processing of your data for further recruitment purposes, your data will be processed until your consent is withdrawn, but no longer than for one year.
  • Employment - personal data will be stored until the legal obligation imposed on the administrator under specific provisions expires, in particular personal data contained in personal files and documentation related to the employment relationship (e.g. payrolls, salary cards, working time records) will be stored for a period 10 years from the end of the employment relationship (personal documentation) Personal data contained in tax or accounting documentation will be stored until the data storage obligations resulting from specific regulations expire, i.e. 5 years, or until the claims expire. Other personal data will be stored for the duration of the contract and until the limitation period for claims under the employment contract expires. Personal data processed on the basis of consent - until the consent is withdrawn or the relationship with the administrator is terminated, and then for the period of limitation of any claims.
  • Implementation of the contract or taking actions aimed at concluding a contract - personal data is stored until the completion of these activities or until the duration of the contract, until the expiry of the legal obligation imposed on us resulting from specific provisions, and then for the period of limitation of any claims arising from this title;
  • Establishing and maintaining business contacts - your data will be stored for the duration of our business relations or until you object to data processing in accordance with Art. 21 GDPR;
  • Responding to inquiries and messages contained in the form - data will be stored for a period of 6 months.
  • Marketing and sending the Newsletter - data will be stored until the consent is withdrawn.
  • Keeping statistics of website visits    data in the form of an IP address will be stored for a period of 5 years.
  • Determining, investigating and defending against claims - data will be stored until the claims expire, which are the periods specified in the law.  

Your rights

You have the right to:

  • access to your personal data;
  • rectification of your personal data;
  • request deletion of your data;
  • processing restrictions;
  • data transfer;
  • object to processing - if personal data are processed pursuant to Art. 6 section 1 letter f GDPR, i.e. our legitimate interest;
  • submit a complaint to the supervisory body - the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warszawa;
  • withdrawal of consent to the processing of personal data - if the data is processed pursuant to Art. 6 section 1 letter a GDPR, i.e. your consent; you can withdraw your consent to processing at any time, however, withdrawal of consent to data processing does not affect the legality of processing based on consent before its withdrawal.
